I. Introduction
These Terms of Use (the “Agreement”) are an agreement between you as a natural person (“you,” “your,” or “user”) and EgoCraft, Inc. (“we,” “us,” or “our”), concerning your access to Avalogica and its services (the “App”). Apple is not a party to these Terms.
These Terms supplement Apple’s standard end user license agreement for the App; they do not replace it. Section VI explains the relationship between the agreements. The Privacy Policy describes our data practices, and feature-specific permissions remain separate. A reference to a third-party document does not by itself incorporate every provision of that document into this Agreement.
Please read this Agreement carefully before using the App. By using the App, you indicate that you have read, understood, agreed, and accepted the Agreement. If you do not agree with (or do not accept) this Agreement, you are not authorized to access or use this App and must immediately discontinue accessing or using it.
II. Changes to this Agreement
We may revise these Terms to reflect changes to Avalogica features or services, address legal or security requirements, or clarify the wording. We will post the revised Terms and update the date on this page.
For material changes affecting existing users’ rights or obligations, we will provide at least 30 days’ advance notice by email or through a notice in the App. The notice will explain the material changes, link to the revised Terms, and state when they take effect. We may use a shorter notice period only when necessary to meet a legal requirement or address an urgent security concern; in that case, we will explain the reason and provide notice as soon as reasonably possible.
Routine wording corrections that do not materially change your rights or obligations may take effect when posted. Changes apply prospectively and do not retroactively change the terms governing an existing dispute.
If you do not agree to a material change, you may stop using the affected services before it takes effect. This does not by itself cancel an Apple subscription; manage cancellation separately as described in Section X. By continuing to use the affected services after the notified effective date, you accept the revised Terms to the extent permitted by applicable law. Where applicable law requires express consent or another form of acceptance, we will obtain it. Changes to these Terms do not replace the feature-specific permissions and choices described in the Privacy Policy.
III. Restrictions on Who May Use the App
You must be at least eighteen (18) years old to access or use the App. No person under eighteen (18) may access or use the App, even with permission from a parent or guardian. Any additional requirements imposed by applicable law also apply.
IV. General Terms
Avalogica is an integrated platform for self-directed personal development. Just Talk, Reflection, Profiles, Journal, and Compose support capturing thoughts, examining them, exploring patterns, preserving approved reflections, and developing material for expression and publication. You remain responsible for deciding what to accept, save, revise, share, or act upon. The App does not guarantee a particular personal-development outcome.
You may use your own work developed through Avalogica for lawful personal, professional, academic, and commercial publication, subject to this Agreement, applicable rights, and the rules of the destination where you publish. This permission concerns your content; it does not give you a right to resell, redistribute, or sublicense the App itself.
Interpretations and Personal Decisions
AI-generated questions, emotional estimates, personality patterns, and other observations can be incomplete or incorrect. Supporting passages help you examine an interpretation; they do not establish a diagnosis, a definitive identity, or a prediction of future behavior. Avalogica provides tools for reflection and writing, not medical care, psychotherapy, emergency response, or professional legal or financial advice. It should not be relied upon as an emergency monitoring service.
You agree not to use the App for illegal, inappropriate, or unauthorized purposes. When creating or analyzing a profile of another real person using identifiable information, you must have their permission for that information and intended analysis, including AI processing, and accurately confirm that permission when asked. Fictional or hypothetical profiles must not be used to disguise identifiable information about real people.
These Terms govern Avalogica. They do not promise access to the forthcoming Avalogica Legacy service or establish terms for that separate service.
V. Privacy Policy
The Avalogica Privacy Policy describes how the App processes account information, personal content, recorded speech, profile inferences, and technical information. It also describes storage, retention, human access, and deletion. Feature-specific choices and permissions remain separate from general acceptance of these Terms.
EgoCraft does not use private writings, recordings, transcripts, memories, or profile inferences for general product-improvement research, evaluation datasets, prompt development, or model training. Processing selected material to provide a feature you request is distinct from reusing it for those purposes. Separate technical analytics and diagnostics are described in the Privacy Policy.
The website’s Terms of Use and Privacy Policy apply when you use the website. They do not replace the app-specific policies.
VI. Apple App License and Intellectual Property
The App is made available through the App Store under Apple’s standard end user license agreement. EgoCraft is the application provider and licensor of Avalogica under that agreement. Apple’s standard EULA governs the license to the downloaded App, including its permitted use and license restrictions.
These Terms provide additional rules for Avalogica services, subscriptions, User Content, and conduct. They do not replace Apple’s standard EULA or restrict the app-use rights it permits. If these Terms conflict with Apple’s standard EULA on an issue concerning the App license, Apple’s standard EULA governs that issue, subject to applicable law.
You must respect EgoCraft’s rights in the App’s source code, graphic design, user interface, company materials, copyrights, and trademarks, subject to applicable law and permitted uses under the App license. These rights are separate from your rights in User Content, which are addressed in Section VII. References to the App license do not expand our permissions over your private content or replace the feature-specific choices described in the Privacy Policy.
VII. User Content
Input and Output
Input Content includes the text, files, images, recorded speech, profile information, and other material you submit. Output Content includes AI-generated responses, transcripts, reflective questions, interpretations, generated memory notes and personality instructions, writing suggestions, and drafts. Together these are User Content. Some outputs are derived interpretations rather than facts supplied by you.
Accountability and Review
You are responsible for the content you submit and for reviewing output before relying on, sharing, or publishing it. Check factual statements, transcripts, quotations, citations, and source references against the underlying material. A source reference or supporting passage does not by itself establish that a claim is accurate, that a quotation is suitable in context, or that you have permission to publish it. Review is especially important in legal, medical, financial, academic, and other consequential contexts.
Saved Memories and Authored Personalities
Memory helps carry selected information and preferences into later conversations. AI-created or merged notes can omit details, preserve an error, or misinterpret a statement, including a statement made by an AI. Review and correct saved notes rather than treating them as independently verified facts or psychological assessments. A fictional personality’s authored characteristics are not evidence about a real person. Memory does not guarantee complete recall or consistent future responses. The Privacy Policy explains how notes are processed, saved, and included in later requests.
User-Created and Customized Personas
You are responsible for the names, descriptions, instructions, personality traits, modifiers, memories, and other material you voluntarily supply or deliberately adopt when creating or customizing a persona, including changes to a personality supplied with Avalogica. This includes AI-generated characteristics or memories that you review and choose to adopt.
You must have the rights and permissions necessary to provide and use this material. Describing a persona as fictional does not remove obligations concerning another person’s privacy, identity, or other rights.
Persona settings influence AI responses but do not fully determine them. Responses may be unexpected, inaccurate, inconsistent, or objectionable. Review generated characteristics, memories, and responses before adopting, relying on, sharing, or publishing them. A simulated persona does not establish facts about, or speak on behalf of, a real person.
EgoCraft does not endorse user-selected characteristics or viewpoints merely because Avalogica processes or displays them. To the extent permitted by applicable law and subject to Section XIV, EgoCraft is not liable for harm to the extent caused by your submitted material, deliberately adopted customizations, or use of persona outputs in violation of these Terms.
Customization does not authorize prohibited conduct or override applicable safety restrictions. Nothing in this section excludes liability that cannot lawfully be excluded or limits EgoCraft’s own legal obligations.
Ownership and Publication
You retain the rights you hold in your Input Content. As between you and EgoCraft, we do not claim ownership of your Input or Output Content. You may use and publish your work, including commercially, subject to applicable law, third-party rights, and applicable provider or publication rules. Permission to use an output does not guarantee that the output is unique, copyrightable, or free of another person’s rights. Other users may receive similar outputs.
You must have the rights and permissions needed to submit source material and authorize the processing involved. Importing a document, quoting someone, or using Compose does not transfer another person’s copyright to you. You remain responsible for required acknowledgments, permissions, and any disclosure of AI assistance required by a publisher, school, employer, or other destination.
Permission to Operate the Features You Use
You authorize EgoCraft and the service providers acting on its behalf to receive, store, copy, process, and transmit your User Content to the extent needed to provide the features you use, handle the support you request, and meet the security or legal needs described in the Privacy Policy. This limited operational permission does not transfer ownership or authorize use of private content for advertising, general product improvement, or model training. AI-provider processing and retention are explained in the Privacy Policy.
Movement Between Features and Removal
A saved Just Talk transcript, a Reflection, its approved Journal entry, associated profile evidence, and an imported Compose source can be distinct records. Removing an approved reflection from Journal removes it from that view; it does not erase its underlying Reflection record or analysis. Compose imports retain independent copies. Changing or clearing a saved memory does not retroactively revise earlier conversations or retract information already sent for processing. Cancelling an AI request does not retract processing that has already occurred. For full deletion requests and retention details, see the Privacy Policy and Contact page.
Optional Publication in Shared
Shared lets you offer a reflection from your own profile for other Avalogica users to read. Before submission, review the sharing copy, remove identifying details, and confirm that you are not exposing or targeting someone else. The publication preview can include a reflection-pattern label and a country you choose to provide. Omitting an author name does not guarantee anonymity if the text or accompanying information identifies you.
By offering material to Shared, you authorize EgoCraft to process it for moderation and, if accepted, display the approved sharing copy and accompanying information within Shared. This is separate from storing the original private journal. Submission does not guarantee publication; material may be held for review, rejected, or removed for moderation or safety reasons. This permission does not transfer ownership or grant a separate right to use your contribution in company advertising or training datasets.
Published contributions expire after 90 days unless withdrawn or removed sooner. A pending moderation copy becomes eligible for cleanup 30 days after submission. A rejected sharing copy becomes eligible for deletion 14 days after the first rejection; retries do not restart that period. Managed cleanup is asynchronous, subject to the legal-retention and backup provisions of the Privacy Policy. Withdrawing a contribution ends its public display through Shared and removes retained candidate text, but cannot retract copies or screenshots already made by readers. The original journal and separate moderation/ownership records have their own lifecycles.
Reading and Reusing Shared Contributions
Shared contributions are offered for reading within Avalogica. Their authors retain their rights. Unless the author separately permits it or applicable law allows it, you may not republish, redistribute, commercially exploit, or collect another person’s contribution into a dataset, or use it to train an AI model. The ability to copy text or take a screenshot does not grant permission for those uses. Nothing in this restriction limits rights or exceptions provided by applicable law.
Reports and Reconsideration
You may report a contribution or hide it using the available in-app controls, or contact us about a concern. If your submission is rejected, you may request reconsideration by emailing service@egocraftai.com. Identify the submission and explain why you believe it should be reconsidered; do not include unrelated private material.
Request reconsideration promptly and before the 14-day period following the first rejection ends. A review request does not automatically extend that period or guarantee a decision before deletion. Once the content is deleted, we may be unable to reconsider the original submission. We do not guarantee acceptance or a particular review response time.
Prohibited Content and Misrepresentation
Do not submit content that violates Section VIII or infringes another person’s rights. Do not falsely represent AI-generated material as entirely human-generated. Your own authorship, selection, revision, and judgment remain distinct from the parts generated by AI. Violation of these Terms may result in suspension or termination of access.
VIII. Responsible Use and Content Boundaries
Legitimate Private Discussion
Avalogica supports honest private reflection, including discussion of trauma, sexuality, grief, anger, distress, difficult experiences, and political, religious, or philosophical ideas. A topic is not prohibited merely because it is painful, controversial, or uncomfortable. Describing an experience, questioning a belief, or seeking understanding is different from promoting harm, exploiting someone, or requesting assistance to carry out abuse.
This distinction does not guarantee that every AI service can process every request. Applicable law and the restrictions of the provider used for a feature still apply. For example, private reflection on political beliefs is distinct from campaign or lobbying assistance prohibited by the relevant provider. A provider may refuse a request even when discussing the underlying subject is legitimate.
Prohibited Conduct
You must not use Avalogica to:
- Commit or facilitate illegal activities, fraud, unauthorized access, or infringement of another person’s rights.
- Threaten, target, harass, defame, exploit, or expose another person’s private information without authorization.
- Encourage or facilitate self-harm, suicide, violence, or abuse. Describing distress or past experiences for legitimate reflection is not, by itself, encouragement of harm.
- Create or distribute child sexual abuse material, non-consensual intimate content, or material that sexually exploits a person. The private-discussion allowance does not authorize prohibited sexual content or requests barred by the applicable AI provider.
- Deceive others through impersonation, fraudulent claims, or deliberate dissemination of materially misleading information.
- Manipulate or interfere with elections, suppress lawful participation, or request political campaigning, lobbying, or other persuasion that the applicable provider prohibits. Studying political ideas or reflecting on your own beliefs is not by itself such conduct.
- Introduce malware, disrupt systems, bypass security or access controls, evade applicable usage restrictions, or misuse another person’s intellectual property.
- Use provider outputs to develop competing AI models where the relevant provider’s terms prohibit that use.
Publication in Shared
Private material is not automatically suitable for public display. Shared contributions must also respect other people’s privacy and the community purpose: they must not target, harass, promote to, or expose others. Moderation may consider identifying details, graphic descriptions, and suitability for other readers. Difficult or painful feelings alone are not grounds for rejection. A Shared rejection does not by itself mean the underlying private reflection is prohibited.
Authorship and Provider Restrictions
Do not falsely present AI-generated material as entirely human-generated or impersonate a human through AI output. Follow disclosure and attribution requirements that apply to your publication destination. Applicable provider policies, including Google’s Generative AI Prohibited Use Policy, OpenAI’s Usage Policies and Anthropic’s Usage Policy, may impose additional restrictions on the services they provide. Violations of this Agreement may result in suspension or termination of access.
IX. Availability of the App, Security, and Accuracy
We do not warrant that the App will be compatible with all hardware and software. We also do not guarantee uninterrupted access to the App and are not responsible for factors outside our control.
Cloud-backed features require network access and functioning third-party services. Access to subscription features may also require successful verification of your Apple purchase and Avalogica account. A temporary verification failure does not necessarily mean that your subscription has expired. Contact support if access does not match your purchase status.
Model responses, processing times, and feature availability can vary. Preview or testing access does not establish a promise that every experimental feature or model will be included in a production subscription. These limitations do not remove rights that applicable law does not allow us to exclude.
X. Charges, Subscriptions, and Cancellation
An Avalogica subscription includes access to all areas of Avalogica, including Just Talk, Reflection, Profiles, Journal, Compose, and Shared, subject to feature eligibility, these Terms, and applicable service restrictions. Inclusion does not promise unlimited processing or override moderation requirements. The App presents available plans and the price, billing period, and any eligible introductory offer before you confirm a purchase through Apple. Availability and prices may differ by region. The purchase offer displayed by Apple governs the transaction; these Terms do not establish a different price or guarantee eligibility for a free trial.
Usage and Fair Use
Avalogica is intended for your own interactive use, including developing work you may publish commercially. You must not use it for unauthorized automated or bulk processing, resell access to its processing services, bypass restrictions, or deliberately generate activity that materially disrupts availability for others. Frequent legitimate use alone is not misuse.
We may restrict activity when reasonably necessary to address such misuse or protect service security and availability. Where practicable, we will explain the reason and give you an opportunity to correct the issue; urgent security or abuse concerns may require immediate action. This is a fair-use restriction, not an undisclosed numerical allowance for ordinary use.
These Terms do not set a numerical daily or monthly allowance for ordinary AI or voice use. If we introduce such allowances, we will clearly state what is counted, the allowance and reset period, and what happens when it is reached. Notwithstanding Section II, we will provide notice before a new numerical allowance applies and disclose it before new purchases or affected renewals, subject to applicable law.
Trials and Introductory Offers
A free trial or introductory price is available only where offered and where Apple determines that you are eligible. Review the offer’s duration, renewal price, and billing period before subscribing. A trial does not guarantee access to every experimental or separately restricted feature. Unless cancelled in accordance with the offer and Apple’s rules, the subscription renews at the price and billing period shown in the purchase offer.
Renewal and Cancellation
Subscriptions renew automatically unless cancelled. Apple processes charges and renewals. Manage or cancel your subscription in your Apple Account’s subscription settings. To avoid renewal of a trial, Apple advises cancellation at least 24 hours before the trial ends. Check the access end date shown by Apple rather than assuming that a cancelled trial will always continue for its full advertised duration.
Removing the App, signing out, or requesting deletion of Avalogica data does not by itself cancel an Apple subscription. Subscription cancellation and data deletion are separate actions. Retention of saved content follows the Privacy Policy; it is distinct from entitlement to paid processing features.
Access After Subscription Expiration
Cancelling renewal does not end an already-paid subscription period early unless Apple’s rules or another applicable condition require it. When paid access expires, paid processing becomes unavailable. You may continue to read, export, and delete your previously saved material without renewing a subscription. Retention remains governed by the Privacy Policy; cancellation alone does not instruct us to erase your work.
This continued access does not include new AI processing and does not restore material already deleted. It applies to subscription expiration or cancellation; account restrictions for security or violations of these Terms are handled separately. You can still contact us to exercise applicable data-access and deletion rights.
Refunds and Purchase Support
For a purchase billed by Apple, you can request a refund through Apple. Eligibility depends on Apple’s rules and applicable law. Nothing here limits mandatory consumer rights. For an Avalogica access or account problem, contact our support team.
XI. Storage, Synchronization, and Exports
The App maintains a library on your device that is configured for Apple CloudKit synchronization, subject to iCloud availability and your Apple account settings. The device and iCloud library may contain material used with more than one Avalogica account; changing Avalogica accounts does not create a separate device library. Apple’s iCloud Terms and Conditions and Apple Privacy Policy apply to its services. Feature-specific processing choices remain separate as described in the Avalogica Privacy Policy.
Some features also store content and analysis in Avalogica’s Google Cloud/Firebase backend; storage is not limited to your device or iCloud. Synchronization, saved feature records, and backups have different purposes and deletion behavior. Refer to the Avalogica Privacy Policy for details.
When you export or publish material to another service, that destination’s rules apply. An exported file is a separate copy. Deleting the source in Avalogica does not erase copies held elsewhere.
Account Deletion and Retained Access
Account deletion requires a final confirmation; preparing a library alone does not submit the deletion request. With the default Keep my library choice, the app saves and checks a separate readable archive of online material on this device before final submission. After the request is accepted, the app signs out and enters Guest Mode. On-device writing and memories, and the retained archive, remain available to read and export. This is separate from access to paid AI processing and does not maintain a connection to the deleted online account. Online cleanup continues as described in the Privacy Policy.
Also erase my library is a separate choice that erases the shared library on this device, including material used with other Avalogica accounts, and requests synchronized deletion through iCloud. This can affect other devices using the same Apple account; propagation depends on connectivity and iCloud availability. Exported files and Apple-managed backups remain separate. Account deletion does not cancel an Apple subscription; manage cancellation separately as described in Section X.
XII. Third-Party Resources and Licenses
Avalogica uses third-party API services to provide AI features. The model or feature you use determines which providers process your content; using Avalogica does not mean every provider receives it. Provider restrictions and service availability can affect the models and features available in the App.
You must follow the content and use restrictions in this Agreement and any provider restrictions that apply to the service you use. Submit only content you have the necessary rights and permissions to use. Section VII describes your rights in Input and Output Content; these Terms do not promise a provider indemnity, copyright protection, or that an output is unique or free of other people’s rights.
EgoCraft remains responsible for its own obligations to its service providers. A provider’s agreement with EgoCraft does not automatically make every provision a direct contract with you or transfer EgoCraft’s contractual indemnification obligations to you. The references below explain the providers’ published terms; they do not incorporate every provision into this Agreement.
The current AI providers available through Avalogica are listed below. Legacy integrations that are not currently offered are excluded.
| API Provider | Service Description | Terms References |
|---|---|---|
| Anthropic | Selected chat responses | Commercial Terms of Service, Usage Policy |
| Gemini through Vertex AI for Baseline and Reflection analysis, Reflection generation, Profile Insight, and Relationships; Reflection speech transcription; other selected Google AI services; cloud hosting, authentication, and data management (Firebase) | Google Cloud Terms, Google Cloud Service Specific Terms, Generative AI Prohibited Use Policy | |
| Mistral AI | Selected chat responses | Commercial Terms of Service |
| OpenAI | Selected chat responses; Just Talk transcription, responses, emotional feedback, and generated speech; memory and authored personality-instruction processing; Compose assistance; Shared moderation | Services Agreement, Service Terms, Privacy Policy |
Provider data handling depends on the service, applicable agreement, and settings. General privacy policies may describe a provider’s website or account practices separately from its handling of API inputs. The Avalogica Privacy Policy explains our data practices and links to relevant provider information. These references do not expand EgoCraft’s permissions over your private content or promise that provider retention is disabled.
XIII. Disclaimer of Warranties
To the fullest extent permitted by applicable law, your use of the App is at your own risk, and the App is provided "as is" and "as available," without any warranties, express or implied. This disclaimer does not exclude warranties, remedies, or consumer protections that cannot lawfully be excluded.
XIV. Limitation of Liability
To the fullest extent permitted by applicable law, EgoCraft is not liable for direct, indirect, special, consequential, or punitive damages arising from your use of the App. Nothing in this Agreement excludes or limits liability for fraud, willful misconduct, gross negligence, or any liability that cannot lawfully be excluded or limited. Mandatory consumer rights remain unaffected. Where applicable law does not permit an exclusion or limitation, it applies only to the extent permitted by that law.
XV. Dispute Resolution and Mediation
If you have a concern, contact service@egocraftai.com so we can try to resolve it. Contacting us is not a prerequisite to exercising your legal rights and does not extend any legal filing deadline. You and EgoCraft may voluntarily agree to mediation; any process, timing, and costs must be agreed separately by both parties. Neither party is required by this Agreement to mediate before pursuing legal action. The separate class-action provision in Section XVI remains applicable subject to applicable law.
XVI. Class Action Waiver
While resolving any disputes with us, you expressly agree to waive the right to pursue or participate in any form of class action lawsuit, arbitration, or other representative proceeding against us. Any claims or disputes arising out of or relating to this Agreement must be handled individually, and not as part of any class or representative action.
XVII. Third-Party Beneficiary
You acknowledge and agree that Apple Inc., and its subsidiaries, are third-party beneficiaries of this Agreement. Upon your acceptance of the terms and conditions of this Agreement, Apple will have the right (and will be deemed to have accepted the right) to enforce this Agreement as a third-party beneficiary.
XVIII. Legal Compliance
You must represent and warrant that you are not located in a country subject to a U.S. Government embargo and are not listed on any U.S. Government list of prohibited or restricted parties.
XIX. Governing Law and Claims
This Agreement is governed by California law and applicable United States federal law, except where the mandatory laws of your place of residence require otherwise. Subject to any nonwaivable rights to bring a claim elsewhere, disputes arising from this Agreement will be heard in a state or federal court in California with jurisdiction over the dispute.
XX. Termination
Voluntarily deleting your Avalogica account does not by itself terminate your permission to use the App in Guest Mode or require you to uninstall it. The retained-library access described in Section XI remains available unless App access is separately restricted or terminated. The following provisions concern access to Avalogica services rather than ordinary account deletion.
We reserve the right to terminate access to Avalogica services under this Agreement at any time, at our sole discretion, and for any reason, subject to applicable law. On termination, you must stop using the affected services. These Terms do not independently revoke the license to the downloaded App or require deletion of the App from your devices. Rights under the App license, and termination of that license, remain governed by Apple’s standard EULA.
Termination of App access does not transfer ownership of your content to EgoCraft or automatically erase every retained record. The Privacy Policy continues to govern retained information and deletion requests. Apple subscription cancellation must be handled separately as described in Section X.
XXI. Severability
If any provision of this Agreement is found to be illegal, invalid, or unenforceable, that provision shall be narrowed or removed to the minimum extent necessary to ensure the Agreement remains in full force and effect. All other provisions shall continue to apply.
